Pharmacy Benefit Management Companies
Solberg, Stewart, Miller & Tjon, in conjunction
with a number of different law firms throughout the United States, has
brought a number of class action lawsuits against pharmacy benefit
management companies (PBMs). These PBMs administer the
prescription drug plans for many large companies and governmental
entities such as cities, counties, townships, and states. The PBMs
charge a substantial administrative fee for providing these services.
We have brought these lawsuits because of
the PBMs self dealing actions. Basically, because the PBMs are so
large, they can obtain rebates from drug manufacturers and pharmacies to
give preferential treatment for their products or services. We
believe the PBMs have the obligation to pass these rebates and savings
on to their clients. Most PBMs only pass on a portion of the
rebates to their clients.
