PPH (Primary Pulmonary Hypertension) – Fen-Phen Claims

Fen-Phen drugs (Pondimin and Redux) have been linked to a very serious condition called “PPH” (primary pulmonary hypertension).  This disease is rare but can often be fatal. Sometimes PPH symptoms do not show up for a number of years after taking Fen-Phen.  Early diagnosis and treatment of PPH is critical.  There are treatments available that can help improve quality of life and extend life expectancy for people diagnosed with PPH. Unfortunately it is often difficult to diagnose PPH and it may take a number of years after the first symptoms appear (usually shortness of breath with minimal exertion) to diagnose PPH.

Primary, or unexplained, pulmonary hypertension (PPH) is a rare lung disorder in which the blood pressure in the pulmonary artery rises far above normal levels for no apparent reason. The pulmonary artery is a blood vessel carrying oxygen-poor blood from the right ventricle (one of the heart's pumping chambers) to the lungs. In the lungs, the blood picks up oxygen, then flows to the heart's left side, where the left ventricle pumps it to the rest of the body through the aorta.

$2,000 FEN-PHEN PAYMENTS

Opt Out Settlements

We have over 270 clients who we have filed lawsuits on behalf of, with the assistance of Attorney George Fleming, and his law firm, in Houston, Texas.  Very recently, after years of litigation and negotiations, George and his team of attorneys have been able to obtain a settlement that appears to be fair.  In the next couple of weeks everyone who has had a lawsuit filed on their behalf will receive information from George Fleming and our office about the proposed settlement. Final Judicial Approval (7th Amendment)

On May 16, 2006, the 7th Amendment achieved “Final Judicial Approval”.  Although Final Judicial Approval has occurred, at this time the Fund Administrators remain unable to state the dollar amount that the people whose cases pass audit will receive based on the relative payment value or their Claim.  The determination of the pro-rata share of the Supplemental Class Settlement Fund can not be made until all Initial Reviews and Second Reviews of Category One Claims have been completed and finalized.  At this time, the Fund Administrators cannot predict when all such reviews will be completed (hopefully by the end of this year), the dollar amount those claims will receive, nor the date or timeframe when that distribution will occur.

Unfortunately, many of the echo audits have resulted in fairly substantial downgrades in echo reads.  This has been a problem for cases nationwide.  The explanation proffered by the 7th Amendment people is that the echoes are now being read by using a computer program, instead of doctors simply “eyeballing it” and giving their impression. By downgrading the echo, the reading cardiologists are stating that the injury or injuries to the heart are not as severe as originally feared and thus the recoveries for those folks whose echoes have been downgraded will be minimal.  Of course, that is not all bad news, since no one wants to have a serious heart problem.

Because of the downgrades, many of our 7th Amendment clients will only receive minimal recoveries.  This actually is good news, since no one wants to have a serious heart valve injury.

We have heard back on the majority of our audits, nearly all have been downgraded, but we are still waiting for all of the echo reads to come in.  If you have a case in the 7th Amendment with our office and have not received the results of your audit from our office, we will contact you as soon as the results are received by our office.
