Tissue Implants - Illegally Harvested
October 11, 2007 UPDATE
As you may have heard, the long anticipated indictments
of several Philadelphia funeral home directors were issued this week. The
indictment details some of the most horrific criminal conduct imaginable,
and underscores the huge public health risk created by the illegal
"harvesting" of human tissue intended for surgical implantation.
We have now filed 2 lawsuits on behalf of victims who
received tainted body parts. Those cases are pending in the MDL in the
Federal Court in Newark, New Jersey. Expert reports have been supplied,
expert depositions taken, and Daubert Hearings will be held this fall on the
issue of whether or not contaminated body parts place recipients at risk of
contracting infectious diseases. We also represent other clients whose cases
have yet to be filed.
As always, we remain available to review any new cases.
Details
A ghoulish scandal was
uncovered in November, 2004 after a routine business dispute between the
buyer and seller of a Brooklyn, New York Funeral Home. The owner of the
funeral home had contracted with the owner of a tissue company to illegally
harvest bone and tissue from corpses. The tissue company failed to properly
harvest, sterilize, package and ship the tissue but distributed it to
hospitals all over the United States for use in transplant surgeries. As a
result, patients who have had transplant surgeries are discovering that they
have been infected with HIV, hepatitis and syphilis. Those that have not
been infected must live with the constant fear of potentially contracting a
disease. If you or a loved one has received a letter from your doctor
asking you to obtain blood tests after the recall of tissue used in your
surgery due to “questions about adequacy of donor documentation,” contact us
for a free consultation. There is no charge to discuss this case with you.
