Texas jury recently found Merck liable for
the death of a 59-year-old man and then awarded his widow
$253 million in damages. Of
that, $229 million was awarded for punitive damages which are designed to
punish Merck for its wrongdoing. This was a wonderful outcome for this
family, unfortunately there have been more cases tried and the juries have
found Merck not liable for the injuries to the plaintiffs in each of those
cases. New trials are ongoing and we hope for the best to the plaintiffs in
those cases.

On September 17, 2001, the Food and Drug Administration (FDA) issued a Warning
Letter to Merck & Co., Inc., the manufacturer of Vioxx, for misrepresenting
the safety of their prescription pain medication. According to the FDA
letter, Merck's promotional activities and materials for Vioxx were "false,
lacking in fair balance, or otherwise misleading in violation of the Federal
Food, Drug and Cosmetic Act" and applicable regulations.
