Fen-Phen Diet Drug Litigation

INTERMEDIATE OPT OUT CASES - LAWSUITS

Solberg, Stewart, Miller and Tjon represent hundreds of injured diet drug users. Last year we obtained meaningful recovery for 30 of our clients whose cases were set for trial. We believe the settlements were fair and our clients were pleased. We have another 15 cases set for trial this winter and spring. We are hopeful that the outcomes will be as favorable for each case, although there are never any guarantees in these situations. There will be many more trial dates set in the near future.

For our clients - many of you will be deposed within the upcoming months.  This is part of the discovery process and it is extremely important that you attend these necessary depositions.  It is CRUCIAL that you cooperate with our office, Zimmerman Reed, and Fleming and Associates in the upcoming months, providing forms as requested.  Be sure to keep us updated with any address, phone, or work changes.  Many of you may be asked to travel for depositions and trials. We will make every effort to make this as painless as possible for the clients.  If you have any questions about this please feel free to contact us.

Most recently, settlement negotiations have occurred on behalf of 20 more of our clients. These settlement discussions actually involve thousands of people, throughout the United States, who were injured by fen-phen. The results of those negotiations should be known in the next few months.

MATRIX CASES – GREEN FORMS AND SEVENTH AMENDMENT

Recently an amendment to the original Settlement Agreement under the AHP Settlement Trust was approved by the judge. This amendment is referred to as the “Seventh Amendment” and does NOT apply to EVERYONE; however, notices regarding the Seventh Amendment have been sent to EVERYONE who filed any type of form with American Home Products – EVER. Because you receive a notice does NOT mean that you are entitled to any type of compensation.

We have sent letters to all of our current clients who we believe the Seventh Amendment pertains to.  If you did not receive a letter from our office and feel that you should have, please contact us.  Conversely, if you receive a letter and have any questions, please feel free to call our office and speak to Lucinda Hopewell. Or if you prefer, you may email Lucinda at lhopewell@solberglaw.com with your questions.

You may also download a complete copy of the Seventh Amendment at www.settlementdietdrugs.com.
