Fen-Phen, Redux and Pondimin
These diet drugs were removed from the market in 1997 but people are still suffering serious heart and lung problems from these drugs. The Fen-Phen drugs caused heart valve damage and a some times fatal condition known as Pulmonary Arterial Hypertension (PAH) or Primary Pulmonary Hypertension (PPH). There was a class action settlement that was approved by the federal court in Philadelphia, Pennsylvania, a number of years ago. So, is it too late to make a Fen-Phen claim?
In general, legal claims and lawsuits for heart damage caused by Fen-Phen are now barred by the settlement agreement entered into in the class action and related litigation. However, some people can pursue Fen-Phen claims even today, if the injured person registered with the America Home Products Settlement Trust. Those who are properly registered with the trust can continue to claim benefits under the terms of the class action settlement until 2011, and may be entitled to monetary recovery if their condition gets worse and if they need heart valve surgery. Solberg, Stewart, Miller and Tjon continue to be active in reviewing claims of Fen-Phen users whose heart problems have gotten worse, especially if their condition has resulted in the need for heart valve surgery.
It is also important to know that Fen-Phen claims and lawsuits by people diagnosed with Pulmonary Arterial Hypertension(PAH) and Primary Pulmonary Hypertension(PPH) are not barred by the settlement agreement. These very serious and often fatal conditions can develop many years after exposure to Fen-Phen. Solberg, Stewart, Miller and Tjon review cases and will represent former Fen-Phen users who now have PAH or PPH
