In our consumer-driven society, we are constantly bombarded with the latest innovations. Many times, however, products that come onto the market are not safe and may even result in injury or death. This can be a confusing and disturbing experience for consumers who expect consumer protections to keep them safe or for products on the market to function as advertised. In a recent article in the San Diego Reader, a Pennsylvania woman won an important victory by a federal judge that not only allows her to sue the manufacturer of a dangerous product, but also the operator of the store where she purchased the product, Kmart.

Imagine purchasing the latest in baby gear, only to have the product result in the death of your child. That is exactly the nightmare that faced Anthoinette Medley of Pennsylvania. Medly, mother of twin infant boys never imagined her purchase of the Infantino SlingRider baby carriers would end in tragedy. Despite the fact that the company had received many complaints of potentially life-threatening dangers with the baby carriers, Medly had no idea her son, Nelsir Scott, was in any danger until she was showing the baby off to a fellow mall patron and realized he was unresponsive. CPR and emergency medical care only confirmed that baby Nelsir had died of suffocation.

Medly filed suit against Sears Holding Corp., Infantino, and Walmart in 2010. Although both Walmart and Sears asked for the lawsuit to be dismissed, a federal judge ruled against their request leaving all parties named to face the lawsuit by a grieving mother.
