A woman in Texas shopping in a Target took a nasty tumble when she walked over a substance that caused her to slip and hit her head on the hard floor according to a report in the Southeast Texas Record. It turns out that the woman was told by employees that the substance on the floor had already been discovered but no one had bothered to clean it up. Furthermore, there were no warning signs or barriers to keep customers from falling. The injured woman sued Target for injuries, loss of income, medical bills, pain, and mental anguish, among other damages.
In cases such as this one, when a person slips and falls inside and the property owner knew about dangerous conditions but failed to warn or correct them, they are more likely to be responsible for damages related to your injury. When people slip on an indoor surface it is usually due to a substance, wax, water, or another slippery or uneven surface. If property owners are careless, they may be liable for your injuries when the dangerous or slippery area is not closed off, there is no warning of danger or when sloppy workmanship contributes to injuries (e.g. applying too much wax, applying it unevenly). Property owners may also be liable if the floors have obstructions such as carpets or mats with rips, tears or other obstructions; where there are holes in a floor or something that can catch shoes and cause a fall.
Old or poorly maintained stairways can also be the cause of slip and fall injuries. When property owners know and do not repair or warn people about dangers they may be liable for injuries. Unmarked steps that suddenly appear, worn steps, poorly maintained or missing railings, holes in steps, and trash or other items that are left on the stairs are all causes of falls on stairs.
Safe and well-maintained escalators and elevators are the responsibility of property owners. Many people can become injured when elevators or escalators are not properly maintained and when limbs, clothing or shoes get caught in elevators and escalators.
